Companies Act, 2013 requires the Valuation report to be obtained at various events like raising of capital by preferential allotment or Private Placement, Issues of shares for consideration otherthan cash, Issue Sweat Equity Shares. Similarly, valuation reports are required to be obtained as part of the liquidation process under the The Insolvency and Bankruptcy Code, 2016.
Registered valuer is a valuer registered with the Registration Authority for carrying out valuation of assets belonging to a class or a class of assets. The Insolvency and Bankruptcy Board of India (IBBI) is the prescribed Registration Authority. The registration is granted by the IBBI to a person having prescribed qualification after qualifying a prescribed Exam. Such Registration is granted for different class of assets i.e Securities & Financial Assets, Land & Building, Plant& Machinery. Only a valuer who has obtained registration for given category can issue valuation reporting pertaining to such category of Assets.
CA Bhanu Kumar, Partner, is a Qualified Registered valuer under the IBC for the asset category Securities and Financial Assets, and is eligible to issue valuation report for Securities & Financial Assets.
ADCA, Issues valuation Report under the Companies Act and under the IBC and other regulations where valuation report from Registered valuer is prescribed. ADCA facilitates obtaining valuation report from Merchant Bankers wherever required towards issue of ESOP and other requirements.
